Whistleblowers’ Protection Act, Haw. Rev. Stat. § 378-61-70

Parties Protected By Statute

Haw. Rev. Stat. § 378-61

 

“Employee” means a person who performs a service for wages or other remuneration under a contract for hire, written or oral, express or implied. Employee includes a person employed by the State or a political subdivision of the State.

 

“Public employee” means any employee of the State or any county, or the political subdivision and agencies of the State or any county, any employee under contract with the State or any county, any civil service employee, any probationary or provisional employee of the State or county, and any employee of any general contractor or subcontractor undertaking the execution of a contract with a governmental contracting agency, as defined in section 104-1.

Protected Actions Under Statute

Haw. Rev. Stat. § 378-62

 

An employer shall not discharge, threaten, or otherwise discriminate against an employee regarding the employee’s compensation, terms, conditions, location, or privileges of employment because:

 

(1) The employee, or a person acting on behalf of the employee, reports or is about to report to the employer, or reports or is about to report to a public body, verbally or in writing, a violation or a suspected violation of:

 

  • A law, rule, ordinance, or regulation, adopted pursuant to law of this State, a political subdivision of this State, or the United States; or
  • A contract executed by the State, a political subdivision of the State, or the United States, unless the employee knows that the report is false; or

 

(2) An employee is requested by a public body to participate in an investigation, hearing, or inquiry held by that public body, or a court action

 

Haw. Rev. Stat. § 378-70

 

(a) In addition to any other protections under this part, a public employer shall not discharge, threaten, or otherwise discriminate against a public employee regarding the public employee’s compensation, terms, conditions, location, or privileges of employment because the public employee, or a person acting on behalf of the public employee, reports or is about to report to the public employer or a public body, verbally or in writing:

 

  • Any violation or suspected violation of a federal, state, or county law, rule, ordinance, or regulation; or
  • Any violation or suspected violation of a contract executed by the State, a political subdivision of the State, or the United States,

 

unless the employee knows that the report is false.

Specific Remedies Authorized By Statute

Haw. Rev. Stat. § 378-63

 

(a) A person who alleges a violation of this part may bring a civil action for appropriate injunctive relief, or actual damages, or both within two years after the occurrence of the alleged violation of this part.

(b) An action commenced pursuant to subsection (a) may be brought in the circuit court for the circuit where the alleged violation occurred, where the complainant resides, or where the person against whom the civil complaint is filed resides or has a principal place of business.

(c) As used in subsection (a), “damages” means damages for injury or loss caused by each violation of this part, including reasonable attorney fees.

 

Haw. Rev. Stat. § 378-64

 

A court, in rendering a judgment in an action brought pursuant to this part, shall order, as the court considers appropriate, reinstatement of the employee or public employee, payment of back wages, full reinstatement of fringe benefits and seniority rights, actual damages, or any combination of these remedies. A court may also award the complainant all or a portion of the costs of litigation, including reasonable attorney’s fees and witness fees, if the court determines that the award is appropriate.

An action for relief from retaliatory actions under subsection (a) may be brought in the appropriate court of this State for the relief provided in this part.”
